EU Commission Takes Action Against Airlines for Misleading Green Claims

by | May 2, 2024

The European Commission, alongside EU consumer authorities, has issued notices to 20 airlines operating within the EU, urging them to rectify misleading green assertions aimed at consumers. Airlines have been given a 30-day ultimatum to outline corrective measures aligning with EU regulations.

This move follows a complaint lodged by the European consumer organization BEUC and its affiliates regarding climate-related flight compensation programs. It also comes after a court ruling in Amsterdam found KLM guilty of vague green advertising claims, prompted by the environmental group Fossielvrij NL.

Although the commission did not disclose the list of targeted airlines due to the preliminary nature of the investigation, initial complaints included carriers such as KLM, Air Baltic, Air Dolomiti, and others. The letters were sent in collaboration with the Consumer Protection Cooperation authorities, responsible for enforcing EU consumer law.

The scrutiny revolves around claims suggesting CO2 emissions from flights can be offset through climate projects or sustainable fuels, alongside vague assertions of green, sustainable, or responsible practices. Additionally, concerns were raised about the accuracy of CO2 emissions calculators and promises of future environmental performance without verifiable targets.

Commission Vice-President Věra Jourová stressed the importance of providing travelers with accurate and scientifically backed information, rather than vague or false claims. Airlines now have a month to address these concerns, with potential sanctions looming if they fail to take action.

BEUC’s Director General Monique Goyens emphasized the growing intolerance towards greenwashing, particularly within the aviation sector, one of the most polluting industries. This crackdown aligns with consumer expectations for transparent and genuinely sustainable options.

Last year, the European Commission proposed stricter regulations to combat misleading green labeling, aiming to empower consumers in making informed choices. However, the finalization of these rules awaits negotiations between the European Parliament and Council, expected after the upcoming European elections.
